Over the past several years, KCIC has written on a regular basis regarding Arrowood Indemnity Company's ill-fated creation, steady decline and eventual liquidation in Delaware. Late last year, the liquidator extended the deadline to file a proof of claim to May 15, 2025. As we approach the deadline, we wanted to re-share our past analysis and pointers for impacted policyholders. If you’re just getting your head around Arrowood’s liquidation, my short explainer video is a great place to start: 

Arrowood traces its lineage back over a century to numerous historic U.S. insurance companies, including (but not limited to) Globe Indemnity Company, Royal Indemnity Company, Royal Globe Insurance Company, Royal Insurance Company of America, Phoenix Indemnity Company, Phoenix Assurance Company of New York, and Security Insurance Company of Hartford, to name just a few. Interestingly, Royal Surplus Lines Insurance Company (now known as MS Transverse Specialty Insurance Company) may not be included in the estate because of complicated transactions and reinsurance agreements. KCIC is continuing to investigate this issue. 

Insureds of these companies, including Royal Surplus Lines Insurance Company (for now), will need to file proof of claim forms to preserve their rights under their Arrowood policies. Arrowood wrote policies throughout the 20th century until ceasing to write new business in 2002. Many insureds have valuable first-dollar Arrowood policies that provide a defense or higher limit umbrella and excess policies. Consequently, Arrowood has been greatly impacted by legacy liabilities, including asbestos, talc, environmental, coal ash, opioids, sexual abuse, PFAS, and others.
